I. General Terms and Conditions

§ 1 Basic Provisions

  1. The following General Terms and Conditions apply to all contracts concluded between you and us as the provider (GST Global Copy Papers) via our website or by other means of distance communication, unless otherwise expressly agreed. The inclusion of any terms and conditions of the customer is hereby expressly rejected.
  2. A consumer within the meaning of these Terms and Conditions is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is a natural or legal person or a legally capable partnership who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

§ 2 Conclusion of the Contract

  1. The subject of the contract is the sale of goods.
  2. By placing the respective products on our website, we submit a binding offer to conclude a purchase contract via the online shopping cart system under the conditions specified in the respective product description.
  3. The contract is concluded via the online shopping cart system as follows:
    The goods intended for purchase are placed in the “shopping cart.” You can access the shopping cart via the corresponding button in the navigation bar and make changes at any time.
    After clicking the “Checkout,” “Proceed to Order,” or similarly labeled button and entering your personal data as well as payment and delivery details, the order details will be displayed to you as an order summary.
    If you use an instant payment system (e.g., PayPal, PayPal Checkout, or similar services), you may be redirected to the website of the payment service provider. After completing the payment process, you will be redirected back to our website where the order summary is displayed.
    Before submitting the order, you have the opportunity to review, correct, or cancel the order.
    By submitting the order using the corresponding button (“Order with obligation to pay,” “Buy now,” “Pay now,” or similar wording), you legally declare acceptance of our offer, thereby concluding the contract.
  4. Requests for quotations submitted by you are non-binding. We will provide a binding offer in text form (e.g., by email), which you may accept within five (5) days unless another acceptance period is specified.
  5. Order processing and transmission of all contract-related information are carried out partly automatically via email. You must ensure that the email address you provide is correct and that receipt of emails is technically possible and not blocked by spam filters.

§ 3 Special Agreements Regarding Payment Methods

  1. Credit Check
    If we provide services in advance, for example when offering payment by invoice, we reserve the right to conduct a credit assessment based on legally permissible methods to safeguard our legitimate interests. We reserve the right to refuse certain payment methods based on the results of such checks.
  2. Payment via PayPal
    If you select a payment method offered via PayPal, payment processing is handled by PayPal (Europe) S.à rl et Cie, SCA, 22–24 Boulevard Royal, L-2449 Luxembourg (“PayPal”). Additional terms of PayPal may apply. Further information is available on PayPal’s website.

§ 4 Right of Retention and Reservation of Title

  1. You may only exercise a right of retention insofar as it relates to claims arising from the same contractual relationship.
  2. The goods remain our property until full payment of the purchase price has been received.
  3. If you are an entrepreneur, the following additionally applies:
    a) We retain title to the goods until all claims arising from the ongoing business relationship have been settled in full.
    b) You are entitled to resell the goods in the ordinary course of business. You hereby assign to us all claims arising from resale up to the amount of the invoice value.
    c) In the event of processing, combination, or mixing of goods subject to retention of title, we acquire co-ownership in proportion to the invoice value.
    d) We undertake to release securities upon request if their realizable value exceeds the secured claims by more than 10%.

§ 5 Warranty

  1. Statutory warranty rights apply.
  2. Consumers are requested to inspect goods immediately upon delivery and report obvious defects or transport damage promptly. Failure to do so does not affect statutory warranty rights.
  3. Deviations from objective requirements of goods are deemed agreed only if expressly disclosed prior to contract conclusion and expressly agreed.
  4. If you are an entrepreneur, the following applies:
    a) Only our specifications and manufacturer descriptions constitute the agreed quality.
    b) We may remedy defects at our discretion by repair or replacement.
    c) The warranty period is one year from delivery, except where mandatory legal provisions apply.

§ 6 Choice of Law, Place of Performance, Jurisdiction

  1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory consumer protection laws of their country of residence remain unaffected.
  2. The place of performance and jurisdiction for merchants, legal entities under public law, or special funds under public law is our registered office.

  3. For inquiries outside the online shopping system, contract details are provided in text form (e.g., by email).

5. Prices and Payment Terms

  1. All prices are total prices and include applicable taxes.
  2. Shipping costs are shown separately during the ordering process unless free shipping is stated.
  3. Available payment methods are displayed on our website.
  4. Payment is due immediately unless otherwise stated.

6. Delivery Conditions

  1. Delivery conditions, delivery times, and restrictions are displayed on the website or product page.
  2. For consumers, the risk of loss passes upon delivery.
  3. For business customers, delivery is at the customer’s risk.

7. Statutory Warranty Rights

Should individual provisions of these Terms and Conditions be invalid or unenforceable, the remaining provisions shall remain unaffected.
